An update from NAR President Tracy Kasper.
After an 11-day trial in the case of Burnett v. NAR et al, the eight-person jury in a Kansas City, Mo., federal courtroom, came back Tuesday and found the National Association of REALTORS® and other corporate defendants liable in the case.
As recently reported in REALTOR® Magazine, on September 28, 2023, the Federal Western District Court in Missouri issued its ruling in the "Floor Plan" case (Designworks Homes, Inc. et al v. Horak et al. Doc# 124, W.D. Mo. 2:18-cv-04093-BCW). The Court held that such drawings constitute "fair use" and may continue to be used when marketing listed homes for sale, without violating applicable architectural design copyright laws.
