Ruling Issued in Missouri "Floor Plan" Case

As recently reported in REALTOR® Magazine, on September 28, 2023, the Federal Western District Court in Missouri issued its ruling in the "Floor Plan" case (Designworks Homes, Inc. et al v. Horak et al. Doc# 124, W.D. Mo. 2:18-cv-04093-BCW). The Court held that such drawings constitute "fair use" and may continue to be used when marketing listed homes for sale, without violating applicable architectural design copyright laws.

This ruling is a MAJOR victory for the real estate industry, and it recognizes the greater public interest of disseminating such important information to home buyers. Missouri REALTORS^® is proud to have supported the defense of this matter as part of our Legal Action Program, along with the Columbia Board of REALTORS^® and the National Association of REALTORS^®.
